Video Submission Terms and Conditions
Please read carefully

I am hereby submitting to Henry J. Productions ("Producer"), a video which contains my writing, production, or appearance, ("Material") and in consideration of the opportunity to be considered for a possible segment for the television series "Random Acts of Music®" (the "Series") and for other good and valuable consideration, I hereby agree as follows:

I understand that Producer, will refuse to accept, consider or otherwise evaluate the Material unless this Submission Release Form along with the Random Acts of Music® talent release form are signed and returned with the Material. I also understand that no confidential relationship is established between Producer and me by my submission of the Material to Producer hereunder. I hereby request and give permission to Producer to evaluate my Material in connection with the Series. I further agree that no obligation of any kind is assumed or may be implied against Producer and that Producer is not obligated to use the Materials or any of the rights granted in this Submission Release Form, including, without limitation, the right to broadcast (in any media) my Material.  I have retained at least one copy of the Material and acknowledge that Producer will not return the Material and shall not be responsible, financially or otherwise, for any loss or damage or destruction or other failure to return the Material.

I affirm that I have the full right and authority to grant Producer full and unrestricted rights to use the Material and that the Producers exercise of such rights shall not constitute an infringement of any copyright, civil, personal or property right of any third party.  I further warrant that I have secured all consents, licenses, clearances of every kind necessary to permit the free and unencumbered broadcast or use of the Material.

I agree to indemnify, defend and hold Producer harmless for any liabilities, losses, claims, demands, costs (including reasonable attorneys' fees), or expenses arising in connection with any breach or alleged breach of the foregoing. For the purposes of this Submission Release Form, the term "Producer" shall be deemed to include any and all subsidiary, affiliated and related entities and each of their respective employees, officers, directors, agents, representatives, licensees and assigns.

I irrevocably grant to Producer and its successors, assigns and licensees, the right to use my Material and any and all information, including biographical information and/or other materials I have supplied, as well as other information Producer may have received from other sources, in connection with the Series; to re-record my Material in any medium, now known or hereafter devised; to edit my Material in any manner in Producer's sole discretion; and to distribute my Material on the Internet and in any and all media, by any method now known or hereafter devised, including for advertising, promotion and merchandising of the Series. 

 

I hereby acknowledge that I have read and understand the terms and conditions of this Submission Release Form.  Any modification or waiver of any of the provisions of this Submission Release Form must be in writing and signed by both parties. I represent and warrant that I have the full right, power and authority to grant the rights herein. I understand that Producer is making substantial expenditures in reliance upon this Submission Release Form and that I may not revoke the rights I have granted herein. I hereby certify that I fully understand the meaning and effect of this Submission Release Form and that I intend to be legally bound hereby.

I represent and warrant that I am 18 years of age or older; if I am under the age of 18, my parent/legal guardian has approved the terms of this agreement where indicated below.

I hereby agree to and confirm the terms of this agreement on behalf of my child or ward, and I represent and warrant that I am legally authorized to do so.
